This legal notice governs access to, navigation on, and use of the Website, as well as any responsibilities arising from the use of its content (understood as "content" being all texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, images, expressions, and information, as well as any other creation protected by national laws and international treaties on intellectual and industrial property).

1. INTRODUCTION
This Privacy Policy applies to users (hereinafter, “Users,” or individually, the “User”) of the website (hereinafter, the “Platform”) made available by COCOMOGO, S.L.U. (“COCOMOGO”) to provide the services offered to Users through the Platform at any given time (hereinafter, the “Services”).

The User is hereby informed that their personal data may be processed for the following purposes:

4. DATA PROCESSED AND SOURCES
The data processed by COCOMOGO as a result of User interactions may come from the following sources:
(i) Data provided by the User.
(ii) Data generated as a result of the development, management, and maintenance of the contractual relationship between the User and COCOMOGO.
COCOMOGO may process personal data in the following categories: identifying data necessary for the provision of the Services and for sending related informational communications, or for compliance with COCOMOGO’s legal obligations (name and surname, age and/or date of birth, identity document number, email address, postal address, phone number, etc., as applicable).
In addition, we may collect information passively by using tracking tools such as browser cookies or similar technologies on our Platform or in the communications we send to you.
When personal data is collected via a form made available to the User on the Platform or through other authorized channels, it will be necessary for the User to provide, at minimum, those fields marked with an asterisk (*) or otherwise indicated as required. Failure by the User to provide all required data may prevent the contracting of the Services or the use of certain Platform features.
In particular, each time the User accesses the Platform, provides COCOMOGO with, or requires COCOMOGO to access any information that allows us to identify the User (whether for browsing the Platform, contracting or using our Services, or establishing commercial or professional relationships with COCOMOGO), this Privacy Policy will apply, along with the general conditions and terms of service provided on the Platform, and any other referenced documents in force at the time.
This Privacy Policy may be amended. Please review it periodically, as the version published on the Platform at any given time will apply. If significant changes are made, we will notify the User through the appropriate channels, depending on the contact information provided. In any event, if the User continues to use the Services after an update, we will consider that the User accepts the updated Policy.
Capitalized terms not expressly defined in this Privacy Policy will have the meaning assigned to them in the applicable general conditions and terms of service.
5. LEGAL BASIS FOR DATA PROCESSING
COCOMOGO processes the personal data provided by the User based on the following legal grounds, depending on the type of data processed.
In general, unless expressly stated otherwise below, the legal basis for processing the User’s personal data is the performance and execution of the contractual relationship between the User and COCOMOGO.
In cases where the purpose of the data processing is to comply with COCOMOGO’s legal obligations, the legal basis is that the processing is necessary to comply with such legal obligations. Examples of this include the User’s date of birth (to ensure they meet the legally required minimum age) or the identity document number (to issue legally and contractually required invoices).
Processing related to the sending of commercial and marketing communications to the User, by any means, regarding COCOMOGO and its business or that of third parties collaborating with COCOMOGO in providing the Services, is based on consent, which may be withdrawn by the User at any time.
6. DATA RETENTION PERIOD
COCOMOGO will retain your personal data for as long as necessary to provide the requested service or to achieve the intended processing purpose. After that, your data will be retained for the legally required periods, depending on the type of data and the purpose of the processing.
Data processed for the purpose of sending you commercial and marketing communications will be retained until you unsubscribe or withdraw your consent to such processing. If you participate in promotional activities, we will retain your data for a period of six (6) months after the end of the activity.
Regardless of the retention periods mentioned above, your data will be kept securely and protected for the time during which legal liabilities related to the processing may arise, in compliance with current regulations. Once these potential liabilities expire, we will proceed to delete your personal data.
7. RECIPIENTS AND DISCLOSURE OF DATA TO THIRD PARTIES
To fulfil the purposes described in this Privacy Policy, we may need to grant access to your personal data to third parties who support COCOMOGO in providing the Services, including:
(i) technology service providers and user support providers,
(ii) marketing, advertising, and reservation management service providers and partners,

COCOMOGO will only disclose your data when necessary for the performance, fulfilment, and control of the contractual relationship established with the User of the Services, as well as to comply with legally mandated obligations. Any other communication or disclosure of data to third parties will only occur with the prior explicit consent of the User.
Data processing will always be carried out by service providers located within the European Economic Area or in countries declared to provide an adequate level of data protection. If, for service efficiency, we conduct future transfers of personal data to service providers located outside this area, we will inform you and implement the necessary safeguards to ensure the security of your data, in compliance with legal requirements.
8. DATA ACCURACY GUARANTEE
The User declares and guarantees that the data provided are true, accurate, complete, and up to date, and is responsible for any direct or indirect damage or harm that may result to COCOMOGO or third parties due to the falsity or inaccuracy of said data. The User undertakes to immediately notify COCOMOGO of any changes to their data entered on the Platform to ensure that the information held by COCOMOGO is always up to date and free of errors.
9. MEASURES TO PROTECT YOUR DATA
To ensure the security and confidentiality of the data, COCOMOGO undertakes to process the User’s personal data in absolute confidentiality, using them exclusively for the purposes indicated in this Policy.
COCOMOGO has implemented appropriate data protection measures and necessary safeguards to protect the rights and freedoms of the data subjects and to prevent alteration, loss, unauthorised processing, or access, taking into account the state of the art, application costs, and the nature, scope, context, and purposes of the processing.
10. RIGHTS REGARDING YOUR PERSONAL DATA
In terms of data protection, the User has the following rights:
(i) Right to access their personal data to know what is being processed and how, and to request a copy of said data.
(ii) Right to rectify any inaccurate personal data.
(iii) Right to request the deletion of their personal data, insofar as they are no longer necessary for the purposes for which they were processed by COCOMOGO, or if COCOMOGO is no longer authorised to process them.
(iv) Right to request, in certain legally established circumstances, the restriction of the processing of their personal data.
(v) Right to object to the processing of their personal data in legally established cases.
(vi) Right to the portability of their personal data, when the legal basis for processing is the User’s consent or the execution of the contract, as indicated in this Privacy Policy.
(vii) Right not to be subject to decisions based solely on automated processing of their data, where applicable.
(viii) Any other rights legally recognised in the field of data protection.
If you have given your consent for the processing of your data for any purpose, you also have the right to withdraw that consent at any time. Withdrawal of consent will not affect the lawfulness of processing based on consent prior to its withdrawal.
To exercise any of these rights, the User or their legal or voluntary representative, as appropriate, may contact COCOMOGO via the following channels:
a) By sending a written request to COCOMOGO’s address indicated in section 2 above, or
b) By email to the address indicated in section 2 above.
In both cases, the subject line should reference “Data Protection”, and a copy of a valid identification document (DNI, NIE, Passport or equivalent, both sides) must be provided to verify the User’s identity. The request should state the reason for the request and the right being exercised.
COCOMOGO also informs you of your right to lodge a complaint, where applicable, with the relevant supervisory authority, which in Spain is the Spanish Data Protection Agency (AEPD).
